1. INTRODUCTION

These Terms of Service (“Terms”) govern your use of the websites, landing pages, forms, scheduling tools, and related online services operated by JB Insurance Brokers, LLC (“we,” “us,” or “our”), collectively the “Service.”

By using the Service, you agree to these Terms of Service. If you do not agree, please discontinue use. Our Privacy Policy explains how we handle personal information.

These Terms include binding arbitration and an individual-claim requirement in Section 18.

2. OUR INSURANCE SERVICES

JB Insurance Brokers, LLC is an independent insurance agency providing assistance with Medicare, health insurance, life insurance, annuities, and other insurance products. We are not an insurance company and do not underwrite the products we offer.

A quote, form submission, or appointment request does not itself create coverage or guarantee eligibility, pricing, or issuance. Products are subject to availability, insurer approval where applicable, and the issuing insurer’s policy or contract.

Do not cancel existing coverage until you have written confirmation that replacement coverage is active.

3. ELIGIBILITY

The Service is intended for adults age 18 or older. You must not have been previously suspended or removed from the Service. You must use it lawfully and have authority to provide information on behalf of another person. Information about children may be provided by an authorized adult when relevant to an insurance request.

4. FORMS AND APPOINTMENT REQUESTS

Please provide accurate information when requesting assistance, scheduling appointments, or submitting applications. We may respond to your request using contact methods consistent with your choices and applicable law.

Submitting a form or accepting these Terms does not itself provide any separately required consent for marketing calls or text messages.

5. COMMUNICATIONS AND TEXT-MESSAGE TERMS

JB Insurance Brokers, LLC offers optional texts about appointments, scheduling, customer support, and requested insurance services. If you separately opt into marketing texts, messages may include insurance information, educational resources, and enrollment reminders.

Marketing and service-message choices are separate. Neither marketing consent nor joining our texting program is required to submit a form, request assistance, or purchase insurance.

The number of messages varies with your requests and interactions. Your wireless plan may charge for incoming and outgoing texts and data.

To stop texts, reply STOP to the sending number. We may send one nonpromotional confirmation; further program texts stop unless you opt in again. To rejoin, complete a new opt-in. We also accept other reasonable requests to withdraw consent.

Carriers are not liable for delayed or undelivered messages.

You may unsubscribe from marketing emails or contact us to stop marketing calls.

Our Privacy Policy describes how we handle contact information and messaging consent.

6. PAYMENTS AND INSURANCE CONTRACTS

Payments for insurance products are handled by the applicable insurer or authorized payment provider. JB Insurance Brokers does not process payments directly. Premiums, payment schedules, refunds, and cancellation rights are governed by the applicable policy or contract and law.

To the extent permitted by law, JB Insurance Brokers is not responsible for payment processing errors or payment issues caused by third-party providers.

These Terms do not change the benefits or obligations under an insurance policy or annuity contract.

7. PUBLIC REVIEWS AND COMMENTS

If you provide a review, comment, or testimonial for publication, you grant JB Insurance Brokers a nonexclusive, worldwide, royalty-free license to use, reproduce, and distribute it in connection with our services, subject to applicable law and any agreed restrictions.

You are responsible for the content you submit and must have the right to submit it. It must not infringe another person’s rights or contain unlawful or offensive material.

This permission does not apply to private inquiries, appointment information, health or financial details, insurance applications, or other information submitted for insurance assistance.

8. ACCEPTABLE USE

You may not use the Service for unlawful purposes, violate others’ rights, post harmful, offensive, or defamatory content, submit malicious software, interfere with security or operation, or attempt unauthorized access to systems or information.

9. THIRD-PARTY SERVICES

Our websites may link to insurers, service providers, or other third parties. Those businesses have their own terms and privacy practices. A link does not by itself constitute an endorsement of all content on another website.

We do not control third-party websites and are not responsible for their content or operation, except as required by applicable law.

10. SUSPENSION OR TERMINATION

You may stop using the Service at any time. We may restrict, suspend, or terminate access, including for violations of these Terms or misuse of the Service.

Ending website access or opting out of communications does not cancel an insurance policy or annuity contract.

11. PRIVACY

Our collection, use, and sharing of personal information are described in our Privacy Policy.

Any separately required permissions for communications or sharing must still be obtained. These Terms do not replace those permissions.

12. CHANGES TO THE SERVICE OR TERMS

We may update, modify, suspend, or discontinue online features. Updated Terms will be posted here with a revised effective date, and we will provide any additional notice required by law.

Continued use after changes take effect indicates acceptance to the extent permitted by law. A change to these Terms does not itself provide new marketing or information-sharing consent.

13. OWNERSHIP AND INTELLECTUAL PROPERTY

Website text, graphics, logos, designs, and other materials belong to JB Insurance Brokers or their respective owners. Except as permitted by law or written permission, you may not copy, reproduce, distribute, or commercially exploit these materials.

14. WEBSITE WARRANTIES

To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee uninterrupted access or that website information will always be complete, current, or free of errors.

These limitations do not override rights or warranties that cannot legally be excluded.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, JB Insurance Brokers will not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability for claims arising from the Service will not exceed $100, to the extent that limitation is legally permitted.

These exclusions and limitations do not apply where prohibited by law and do not reduce benefits owed under an insurance policy or annuity contract.

16. GENERAL TERMS

These Terms of Service, together with the referenced Privacy Policy and Disclaimers, constitute the entire agreement between you and JB Insurance Brokers concerning use of the Service, except for separately agreed terms for specific services. Separate insurance contracts and other specifically applicable agreements govern their respective products and services.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision does not waive our right to enforce it later.

17. COPYRIGHT COMPLAINTS AND DMCA NOTICES

We respect intellectual property rights and review copyright complaints under applicable law, including the Digital Millennium Copyright Act (DMCA), where applicable.

Your notice should include:

• Your physical or electronic signature, or that of someone authorized to act for the copyright owner.

• Identification of the copyrighted work you believe has been infringed.

• Identification of the allegedly infringing material and its location on our Service.

• Your mailing address, telephone number, and email address.

• A statement that you believe in good faith that the disputed use is not authorized by the copyright owner, its agent, or the law.

• A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.

We will review notices and take appropriate action, including removing or disabling access to material when required by applicable law. We may terminate access for repeat infringement where appropriate.

18. DISPUTE RESOLUTION, ARBITRATION, AND NO CLASS ACTIONS

In the interest of resolving disputes between you and JB Insurance Brokers in a cost-effective and timely manner, you and JB Insurance Brokers agree that any dispute arising out of or relating to these Terms or your use of the Service will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury. Arbitration allows for more limited discovery than in court and is subject to limited review by courts. Arbitrators can award the same damages and relief that a court can award.

You agree that, by entering into these Terms, you and JB Insurance Brokers are each waiving the right to a trial by jury or to participate in a class action. This agreement to arbitrate applies to all claims arising out of or relating to these Terms or the use of the Service, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms.

Exceptions
Despite the above, either party may bring an individual action in small claims court or pursue enforcement action through applicable government agencies. This arbitration agreement does not prevent either party from seeking injunctive relief in court.

Arbitration Process
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Clearwater FL, unless both parties agree otherwise. The AAA rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting JB Insurance Brokers.

Each party will be responsible for their own costs associated with arbitration unless otherwise determined by the arbitrator. The arbitrator’s decision will be final and binding.

No Class Actions
You and JB Insurance Brokers agree that each may only bring claims against the other in an individual capacity, and not as a plaintiff.
